| On June 21, 2005, James Lloyd
and Susan Lenox doing business as CHRISTIAN MEDIA NETWORK, working through
legal council, filed a Motion with the Jackson County Circuit Court
in Medford Oregon, to EXCLUDE THE BIBLE from the $200,000 lawsuit
which they filed against a housewife-Linda Kristich on March 18, 2005, for Civil
Defamation. Kristich has counter-sued also claiming civil
defamation.
The lawsuit is the result a series of high profile accusations over the past three+ years between Christian Media Network and a small local ministry located in Jacksonville Oregon, the Beacon of Truth. What is most unusual is that Christian Media Network which has asked to court to remove any mention Kristich has made to the Bible, claims to be a “Bible based ministry”, which maintains that the Courts are ruled by “the Devil”, even as they initiated the lawsuit. The motion asks the Court to "Strike" any mention of HIS Word calling the Scriptures "a sham" and referring to Kristich’s mentioning the Bible in her answer as "irrelevant pleadings". The pertinent portion of the Motion reads as follows: "Defendant Kristich's Counter-Claim Contains Numerous References To The Holy Bible, Which Are Not Relevant To This Proceeding And Should Be Stricken. Defendant Kristich has attempted to state a claim for defamation in her 132 page Amended Answer. The Amended Answer contains many references to verses from the Holy Bible, which are irrelevant pleadings. Defendant Kristich cannot sue or maintain a claim based on the Holy Bible and this Court is not responsible for enforcing the provisions of the Holy Bible. Accordingly, the multiple references to verses in the Holy Bible in the Counter-Claim should be stricken". Kristich maintains that the Bible is relevant to the case, as she has been sued for publishing her religious opinions on a one hour shortwave radio broadcast which she sub-hosted on January 1, 2005, and for her refusal to “submit to the authority of Christian Media Network” whom she stopped supporting financially in 2002. The case was set to be tried on June 27, 2006 in front of a twelve person jury. The trial has now been consolidated with Craig Portwood and was to be held on an occult holy-day, namely the seventh of July or 7-11-06. The trial date is now set to be heard during the Passover season in early April of 2007. Both Kristich and Portwood are scheduled to defend the truth in court, against a self-proclaimed "Christian" business. Kristich and Portwood have maintained that Christian Media Network could not possibly be a Christian business and file the Motions they file. The text of the Motion read as follows:
This all came from a man who says he loves Jesus Christ and who says that "God sent me…" John 16:2 They shall put you out of the synagogues: yea, the time cometh, that whosoever killeth you will think that he doeth God service. 16: 3 And these things will they do unto you, because they have not known the Father, nor me. This is also the man who claims that he is a "Christian" and those he is suing are "Heathens". Kristich maintains that it is wrong for Christian Media Network to be suing Christians in a court of law. She also believes that James Lloyd is not the "prophet of the Lord" he claims to be, he is an imposter, and a fraud as his fruits so plainly show. Deuteronomy 18:22 When a prophet speaketh in the name of the LORD, if the thing follow not, nor come to pass, that is the thing which the LORD hath not spoken, but the prophet hath spoken it presumptuously: thou shalt not be afraid of him. Yet, many are afraid to condemn the obvious and prefer to let Kristich and another to be sacrificed to magistrates. The battle lines have been drawn; The faith of James Lloyd, Susan Lenox et al dba Christian Media Network in their economic might and corporate lawyer VS. The prayers of the economic nobody-Linda Kristich, her children, and fellow soldiers in the Service of the Lamb of the Almighty and their collective faith in HIM, His Son and His Heavenly Spirit. Will the Almighty allow the corporate might of CMN to prevail in courts of commerce or will the prayers of the faithful prevail? Kristich has lost battles, but who will ultimately win the war? Who will be glorified if CMN wins? Their attorney? Their economic might? Kristich maintains that should she win the Almighty deserves the praise and the glory for the victory. Many stand by the sidelines watching and awaiting the outcome, but did it really have to come to this? First they came for the socialists, and I did not speak out — Qui tacet consentit is Latin for “silence implies consent.” It is a concept very much at play among the so-called Christian population. Will the Almighty indeed hear the prayers of those too timid to condemn unrighteousness when their trials begin? Revelation 21:8 But the fearful, and unbelieving, and the abominable, and murderers, and whoremongers, and sorcerers, and idolaters, and all liars, shall have their part in the lake which burneth with fire and brimstone: which is the second death.
